PRIVACY POLICY  

 

I. GENERAL PROVISIONS

  1. Privacy Policy of the Internet Service ProCASE DORADCY PRAWNI I EKONOMICZNI SP. Z O.O. (hereinafter: "ProCASE Service") has information character and it is not the source of duties for the Visitors.

  1. The Controller of the personal data processed via the ProCASE Website is ProCASE DORADCY PRAWNI I EKONOMICZNI spółka z ograniczoną odpowiedzialnością with its registered seat in Wrocław at the address ul. Hubska 52/11B, 50-502 Wrocław, entered into the National Court Registry by the Regional Court for Wrocław-Fabryczna in Wrocław - Sąd Rejonowy dla Wrocławia-Fabrycznej we Wrocławiu, VI Economic Division of the National Court Registry under the number KRS 0000264032, NIP 8971719749, hereinafter referred to as "Controller".

  1. Personal data of the Visitor, who disclosed them by visiting the ProCASE Website or by entering them on the ProCASE Website, are collected and processed pursuant to the binding provisions of the law, in particular following to the General Data Protection Regulation (GDPR) and with the Act on protection personal data, dated 10th May 2018.

  1. The Controller processes the Visitor's data in the scope including: name, e-mail address, IP address, domain name, browser type, operating system type and other data disclosed by the Visitor at his/her discretion by entering on the ProCASE Website (e.g. telephone number, address of residence, address for service/delivery).

  1. The Controller processes, in particular, the name, surname and e-mail address provided by the Visitor for the purposes indicated in Article III hereinbelow.

  1. Pages of ProCASE Website use Cookies stored on the Visitor's device, in order to provide services following to this Policy, in particular in accordance with the Cookies Policy (Article VIII) and Article II point 2 hereinbelow. By clicking the "I Agree" button when entering on page of the ProCASE Website, the Visitor gives his/ her consent to processing his/her personal data by the Controller, i.e. data obtained through Cookies (IP address, domain name, browser type, type of operating system). Expressing consent is voluntary, although its lack may prevent the Visitor from using the ProCASE Website. Detailed issues concerning the use of Cookies, including the scope, type and manners of using Cookies, as well as the rights and duties of the Visitor, are set out in the Cookies Policy in Article VIII hereinbelow

By checking the appropriate box and entering data on the webpage of ProCASE Website contact form, the Visitor voluntarily gives his/her consent to processing his/her personal data by ProCASE as the Controller of his/her personal data, within the scope covering the name, surname, e-mail address on the terms and conditions specified in this Policy, for the purpose of establishing contact, taking steps prior to entering the possible contract or performing the contract and for the statistical purposes. Granting the abovesaid consent is voluntary, although lack of this consent may prevent the performance of the services.

By checking the appropriate box on the webpage of ProCASE Website contact form, the Visitor voluntarily gives his/her consent to receiving commercial information (marketing information) from ProCASE on the e-mail address given by him/her through ProCASE Website, for the purpose of direct marketing of ProCASE own services or third parties’ services, including entities connected with the Company and to process his/her personal data, i.e. the data collected in that manner (e-mail address, name and surname) by the Company for these purposes. Providing personal data (e-mail address, name and surname) is voluntary, although it is necessary for receiving commercial information about the services of the Controller or third parties, including its affiliates (Newsletter).

  1. The Controller processes the data of the Visitor based on the legal basis and following to the law, faithfully and fairly, in a transparent manner for the Visitor, for specific purposes and not "on the stock", no more than necessary nor longer than necessary, demonstrating concern for the correctness of data and ensuring proper data security.

  1. The term "ProCASE Website" should be understood as a collection of webpages and other documents made available on the Internet to present the services of ProCASE DORADCY PRAWNI I EKONOMICZNI SP. Z O.O., conducting marketing activities, establishing contacts with people interested in using the services of the Company or its affiliates, presenting information connected to the activity and for the proper performance of any possible contractual obligations.

 

II. THE STATUS OF THE VISITOR AND THE TYPE OF DATA COLLECTED BY THE CONTROLLER

  1. The term ‘Visitor’ is referred to each person visiting webpages of the ProCASE Website.

  1. During browsing the webpages of the ProCASE Website by the Visitor, data relating to the Visitor are automatically collected. The abovesaid data covering: IP address, domain name, browser type, type of operating system. These data can be collected by Cookies files ("Cookies").

  1. The Controller also processes anonymized operational data other than collected by Cookies, related to the use of the ProCASE Website (IP address, domain) for generating statistics used in the administration of the Website, subject that the data collected have aggregated (collective) and anonymous character, i.e. they do not contain features identifying Visitors to the ProCASE Website. These data shall not be disclosed to third parties.

  1. For statistical purposes ProCASE Website is integrated with its own statistical system and with statistical mechanisms: Google Analytics.

 

III. PURPOSES AND BASIS FOR THE PROCESSING PERSONAL DATA

The Controller processes the personal data of Visitors because it is necessary for:

  • undertaking actions necessary prior to entering into a contract or for the performance of a concluded contract, including actions necessary for providing services covered by the contract (the basis of Article 6 section 1 point b pf the GDPR)

  • archival purposes to secure information in the event of a legal need to prove facts, which is a legitimate interest of the Controller (the basis of Article 6 section 1 point f of the GDPR)

  • the purpose of possible determination, bringing/seeking or defence against claims, which is a legitimate interest of the Controller (the basis of Article 6 section 1 point f of the GDPR)

  • the purpose of performing legal obligations resulting from the provisions of the tax and fiscal law (the basis of Article 6 section 1 point f of the GDPR)

  • purpose of checking customers’ satisfaction and to determine the quality of Our service, which is a legitimate interest of the Controller (the basis of Article 6 section 1 point f of the GDPR)

  • purpose of directly offering the goods and services (direct marketing) pf the Controller or a third party, including entities associated with the Controller, which is a legitimate interest of the Controller or a third party (the basis of Article 6 section 1 point f of the GDPR)

 

IV. INFORMATION ON VOLUNTARINESS OF GIVING THE DATA

Providing data is voluntary, but it may be necessary for possible contact with the Controller and the provision of services, and it may be necessary to receive commercial information about the Controller's services or third parties, including its affiliates (Newsletter).

 

V. THE TRANSFER OF PERSONAL DATA

1. The Controller is entitled to transfer personal data to the following categories of entities:

  1. entities whose services the Controller uses in processing the said data, i.e. companies providing the Controller with telecommunication services, IT, legal and accounting services,

  2. entities involved in the performance of the contract, in particular entities affiliated with the Controller,

  3. entities providing marketing services.

2. The Controller does not transfer the collected personal data accross the borders of EU/European Economic Area nor to any international organisation.

 

VI. THE PURPOSE OF STORING PERSONAL DATA

Data of the Visitors collected for the purposes referred to in Article III hereinabove, shall be processed by the Controller within the period necessary to secure the rights and claims of the Controller.

 

VII. TIME OF STORING PERSONAL DATA

       1. Visitors have the following rights:

  • the right to request from the Controller access to the data and receiving copies, 
  • the right to rectification (amend) data, 
  • the right to erasure of personal data, 
  • the right to restriction of processing concerning the data, 
  • the right to object to processing, 
  • the right to data portability, 
  • the right to lodge a complaint to the President of the Personal Data Protection Office, 
  • the right to withdraw the consent for processing the personal data.  
  1. The exercise of the abovesaid rights of the Visitor takes place by submitting a request to the Controller by sending a relevant message in writing or by e-mail to the Controller's address indicated at the beginning of this privacy policy or by telephone at number: 71 794 82 30 or directly at the Controller's office.

 

VIII. COOKIES POLICY

  1. Cookies files (Cookies) are IT data, in particular small text information in the form of text files, intended for using webpages, sent by the ProCASE Website to be saved and stored in the Visitors' end devices (e.g. on the hard disk of the computer, laptop or on the smartphone's memory card - depending on what device the Visitor of the ProCASE Website uses).

  1. Expressing consent to save Cookies by Visitors is voluntary, although it may be necessary to use the ProCASE Website or to contact the Controller.

  1. When Visitors are using the Website, the Controller may process the data contained in the Cookies for the following purposes:

  1. umenable launching on the ProCASE Website its basic functionalities, such as access to secure areas on the website; without these Cookies, the Website that the Visitor would like to use, may not display correctly,

IX. FINAL PROVISIONS

  1. The provisions of this Privacy Policy of ProCASE Website are governed by the Polish material and procedural law.

  1. The Controller is properly making available the following technical measures preventing the collection and modification by unauthorized persons the personal data send through electronic meanings:

  1. protecting data against unauthorized access, 

  2. SSL certyficate. 

  1. ProCASE Website may contain links to other webpages.

  1. The Controller recommends to view privacy policy setttled on the other websites after leaving ProCASE Website. This privacy policy concerns only the ProCASE Website.
